Conditions of Membership

 

In applying for membership with Volleyball NSW (VNSW), individuals acknowledge and agree to the following terms:

  1. Membership will include affiliation with their club (where applicable), Volleyball NSW, and Volleyball Australia (VA).
  2. All memberships, regardless of the date of purchase, will expire annually on 31 March.
  3. All members must register through a VNSW-affiliated club. For assistance in finding a club, click here.
    1. VNSW reserves the right to permit direct membership with VNSW for certain programs and events.
  4. By joining a VNSW-affiliated club, individuals automatically become members of VNSW. Members agree to adhere to all applicable rules, regulations, by-laws, and safeguards designed to provide a safe and inclusive environment for all participants.
    1. VNSW retains the right to revoke membership for any breach of these obligations.
  5. Except as required by law and to the extent such exclusions are permitted, individuals agree that as a condition of membership, VNSW and VA are absolved of all liability for any injury, loss, or damage (including fatal incidents) arising from membership or participation in any VNSW or VA activities.
  6. In consideration of VNSW and VA accepting an application for membership, the individual agrees to:
    1. Fully release and discharge VNSW and VA from any and all claims, liabilities, or demands that may arise, or could have arisen, in connection with their membership or participation in any VNSW and VA activities, except where such claims are not permitted to be excluded by law.
    2. Indemnify and hold harmless VNSW and VA, to the extent permitted by law, against any claims, liabilities, or demands made by any third party, including but not limited to other members or affiliates of VNSW and VA, arising from or in connection with their membership or participation in any VNSW and VA activities.
  7. Members declare that they are, and will remain, medically and physically fit to participate in any VNSW and VA activities. They must not pose a risk to their own health and safety or that of others. Members agree to promptly notify VNSW and VA in writing of any changes to their fitness or ability to participate. They acknowledge and accept that VNSW and VA will rely on this declaration as confirmation of their ongoing fitness and ability to participate.
  8. Individuals warrant that all information they provide to VNSW and VA is accurate, complete, and truthful.
  9. Individuals provide information necessary for VNSW and VA’s objectives and consent to its use for general business purposes and membership services. They have the right to access their information through VNSW and acknowledge that VNSW and VA may collect, use, or share their information as permitted by law.
  10. Individuals consent to VNSW and VA capturing their image, including photographs and video recordings, during participation in VNSW and VA activities. They acknowledge that VNSW and VA hold ownership rights to these materials and may use them for promotional or other purposes without requiring additional consent. Furthermore, individuals agree to the use of their name, image, and likeness in connection with VNSW and VA activities for promotional purposes across any form of media.
  11. The VNSW Board reserves the right to reject membership applications or revoke membership at its discretion and at any time.

Volleyball is an inherently dangerous activity, with the potential for serious accidents that may result in injury or death. By applying for membership, individuals confirm they have voluntarily read and understood this warning and accept the inherent risks associated with the sport.

By applying for VNSW membership, individuals agree they have read, understood, and acknowledged all terms and conditions outlined in this document. This includes, but is not limited to, the acknowledgment of inherent risks associated with volleyball, compliance with membership rules and obligations, consent for the use of personal information and images, and the release and indemnity provisions. Upon successful application, they will be entitled to the benefits, privileges, and services of VNSW and VA membership at the level applied for and purchased. As registered members, individuals agree to conduct themselves in a manner that upholds the reputation of themselves, VNSW, VA, and the sport of volleyball. Failure to adhere to these standards may result in sanctions imposed by one or more of the aforementioned bodies.


Bossley Bears Volleyball Club

Membership Terms and Conditions

By registering for membership with Bossley Bears Volleyball Club, individuals acknowledge and agree to the following Terms and Conditions.

These Terms apply to all participants including members, trial participants, guests, and visitors attending any activity organised by the Club.


1. Membership Affiliation

Membership with Bossley Bears Volleyball Club includes affiliation with:

  • Bossley Bears Volleyball Club

  • Volleyball NSW (VNSW)

  • Volleyball Australia (VA)

Members agree to comply with all applicable rules, regulations, policies, by-laws, codes of conduct, and safety guidelines issued by:

  • Bossley Bears Volleyball Club

  • Volleyball NSW

  • Volleyball Australia

Memberships may expire annually on 31 March in accordance with Volleyball NSW membership cycles unless otherwise specified.

The Club reserves the right to accept, reject, suspend, or revoke membership at its discretion in accordance with applicable disciplinary policies.


2. Participation and Inherent Risk

Volleyball is a physical and inherently dangerous sport.

Participation in volleyball activities may involve risks including but not limited to:

  • physical injury

  • serious injury

  • permanent disability

  • illness

  • property damage

  • death

By participating in activities organised by Bossley Bears Volleyball Club, members acknowledge and accept that participation is undertaken entirely at their own risk.

Members acknowledge that accidents may occur despite reasonable precautions being taken.


3. Recreational Activity Warning

Under the Civil Liability Act 2002 (NSW), participation in recreational activities involves inherent risks.

By participating in activities organised by Bossley Bears Volleyball Club, individuals acknowledge that they are engaging in a recreational activity and accept the risks associated with such participation.

The Club is not liable for harm suffered as a result of risks inherent to recreational activities.


4. Medical and Physical Fitness Declaration

By registering as a member, individuals confirm that they:

  • are medically and physically fit to participate in volleyball activities

  • do not suffer from any medical condition that may prevent safe participation

  • will notify the Club of any injury or medical condition that may affect participation

Participants acknowledge that they participate entirely at their own risk.

The Club may rely on this declaration when permitting participation.


5. Release and Waiver of Liability

To the fullest extent permitted by law, participants release and discharge:

  • Bossley Bears Volleyball Club

  • Volleyball NSW

  • Volleyball Australia

  • the Club’s committee members, officers, employees, coaches, volunteers, contractors, and event organisers

from any liability for injury, loss, damage, or death arising from participation in any Club activity.

This includes but is not limited to:

  • training sessions

  • classes

  • open play sessions

  • leagues

  • competitions

  • social events

  • private coaching sessions

This release applies except where liability cannot be excluded under Australian law.


6. Indemnity

Members agree to indemnify and hold harmless:

  • Bossley Bears Volleyball Club

  • Volleyball NSW

  • Volleyball Australia

  • their officers, employees, volunteers, and representatives

from any claims, damages, liabilities, or costs arising from:

  • their participation in Club activities

  • negligent, reckless, or unlawful conduct

  • damage caused to facilities or equipment

  • claims made by third parties resulting from their actions.


7. Membership Fees and Subscription Payments

Certain membership types operate on a recurring weekly subscription model.

By registering for a subscription membership, members acknowledge that:

  • membership fees will be charged automatically on a recurring basis

  • payments will be processed through the Club’s authorised payment provider (currently Stripe)

  • members are responsible for ensuring payment details remain valid and up to date

Failure to maintain valid payment details may result in:

  • suspension of membership access

  • restriction from booking sessions

  • cancellation of membership.

The Club reserves the right to update membership pricing with reasonable notice.

Representative Membership Fee Adjustment

Members registered under the Rep Add-On membership acknowledge and agree that:

  • Upon completion of the applicable representative season, their membership will automatically transition to the Club’s Rally Membership (or equivalent standard membership tier)

  • The applicable Rally Membership fee will replace the Representative Membership fee from the next billing cycle

  • No action is required from the member for this transition to occur

Members will be provided with reasonable notice prior to any fee change in accordance with applicable consumer laws.

Continued membership after the transition constitutes acceptance of the updated membership tier and fees.


8. Minimum Commitment Memberships

Some membership tiers may require minimum commitment periods including:

  • Three (3) months

  • Six (6) months

Members registering for these plans acknowledge that:

  • Payments must continue for the minimum commitment period

  • Cancellation cannot occur before the commitment period ends except in exceptional circumstances approved by the Club.

If a member requests cancellation before completing the minimum commitment period, the Club may apply an early termination fee of $150.

However, a one (1) week grace period applies from the date the membership first begins. During this grace period, members may cancel their membership without the early termination fee.

After the minimum commitment period expires, membership continues on a recurring basis until cancelled.

8A. REP ADD-ON ELIGIBILITY

Access to the Rep Add-On and any associated Representative (Rep) program benefits is conditional upon the member’s account being in good financial standing.

Members acknowledge that:

  • All Rep Add-On fees and any associated membership payments must be fully up to date

  • Overdue or failed payments may result in immediate suspension of access to Rep training, sessions, competitions, and related benefits

  • The Club reserves the right to restrict or remove access to the Rep Add-On until any outstanding balances are cleared

Access will only be reinstated once all outstanding payments have been successfully processed.


9. Membership Cancellation

Members may cancel their membership after any applicable commitment period by submitting a cancellation request through the Club’s membership system.

All memberships require a two (2) week cancellation notice. Please note that the minimum commitment period must be completed before the notice period can begin.

Cancellation will take effect two (2) weeks after the cancellation request is submitted.

During this notice period, members may continue to access Club activities in accordance with their membership level.

Membership access continues until the end of the applicable paid billing period.

The Club may suspend or cancel memberships where:

  • payments repeatedly fail

  • members breach Club rules

  • members misuse the booking system

  • behaviour endangers other participants.

No refunds will be issued for partially used membership periods unless required by law.


10. MEMBERSHIP PAUSE / HOLD

Members may request to temporarily pause or place their membership on hold.

The following conditions apply:

  • A minimum of one (1) week notice must be provided before the pause/hold begins.

  • Memberships may be paused for a maximum total of six (6) weeks per calendar year.

  • Pause requests must be submitted through the Club’s membership system or by contacting Club administration.

During an approved pause period:

  • membership billing may be suspended

  • access to Club sessions and activities will be temporarily restricted.

The Club reserves the right to approve or decline pause requests depending on operational requirements.


11. Session Bookings and Capacity Limits

Participation in Club activities requires prior booking through the Club’s booking system.

Members acknowledge that:

  • sessions have limited capacity

  • bookings are allocated on a first-come basis

  • attendance is subject to availability.

Membership does not guarantee access to specific sessions or events.

Unlimited membership benefits refer only to the ability to attend sessions within available capacity.

The Club reserves the right to modify session schedules or capacities.


12. Booking and Attendance Rules

Members agree to comply with all booking rules including:

  • booking limits

  • cancellation deadlines

  • session capacity limits

  • guest participation rules.

Failure to comply may result in:

  • booking restrictions

  • temporary suspension of booking privileges

  • membership suspension.


13. No-Show and Late Cancellation Policy

Members must cancel bookings at least six (6) hours before the scheduled session.

Failure to cancel within this timeframe may result in a strike under the Club’s attendance policy.

Repeated no-shows may lead to:

  • temporary booking suspension

  • restriction of access to sessions

  • membership downgrade or cancellation.

These measures ensure fair access for all members.


14. Guest Participation

Members may bring guests to certain sessions subject to Club policies.

Guests must:

  • register with the Club

  • complete any required waivers

  • comply with all Club rules.

The Club may restrict guest access where capacity or safety requires.

Guest participation may be permitted at the discretion of the Club and may require manual booking by Club staff. Guest attendance is subject to availability and Club policies.


15. Introductory Short-Term Trial Membership

The Club may offer Introductory Short-Term Trial Memberships, including trial memberships recognised by Volleyball NSW.

Trial participants acknowledge that:

  • this trial membership does not include insurance coverage through Volleyball NSW or Volleyball Australia

  • participation occurs entirely at their own risk

  • the Club is not responsible for injury or loss arising from trial participation except where liability cannot be excluded under law.

Trial memberships are intended for introductory participation only and may be limited in number or duration.


16. Photography and Media Consent

Participants consent to Bossley Bears Volleyball Club capturing photographs or video recordings during activities.

These materials may be used for:

  • promotional materials

  • social media

  • marketing

  • websites

  • club communications.

Participants acknowledge that these materials may be used without compensation.


17. Member Conduct

Members must behave in a respectful and responsible manner.

Members must comply with:

  • Club rules

  • codes of conduct

  • safeguarding policies

  • directions from coaches or staff.

Failure to comply may result in disciplinary action including suspension or termination of membership.


18. Facility and Venue Conditions

Activities may be conducted at facilities operated by third parties including schools or hired venues.

The Club is not responsible for:

  • venue closures

  • facility restrictions

  • cancellations caused by circumstances outside the Club’s control.

The Club may modify schedules where required.


19. Property Damage

Members are responsible for any damage caused to Club equipment or facilities through misuse or negligent behaviour.

The Club may seek reimbursement for repair or replacement costs.


20. Privacy and Personal Information

Personal information provided during registration may be collected, stored, and used by:

  • Bossley Bears Volleyball Club

  • Volleyball NSW

  • Volleyball Australia

for purposes including:

  • membership administration

  • insurance

  • competitions

  • communications

  • organisational operations.

All information will be handled in accordance with applicable privacy laws.


21. Amendments to Terms

Bossley Bears Volleyball Club may amend these Terms and Conditions from time to time.

Updated terms will be published on the Club’s website or membership system.

Continued participation after amendments constitutes acceptance of the revised terms.


22. Acceptance of Terms

By registering for membership with Bossley Bears Volleyball Club, individuals confirm that they:

  • have read and understood these Terms and Conditions

  • acknowledge the risks associated with volleyball participation

  • agree to comply with all Club rules and policies

  • accept the waiver, release, and indemnity provisions contained in this document.

Upon acceptance, members are entitled to the benefits and privileges associated with their membership level.
